1. Introduction

Welcome to VisaWiser. These Terms of Service ("Terms") govern your use of the VisaWiser platform, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

VisaWiser Ltd ("we", "us", "our") is a company registered in England and Wales.

Important Notice

VisaWiser is a marketplace platform that connects clients with regulated immigration advisers. VisaWiser does not provide immigration advice. All immigration advice is provided by independent, regulated advisers who are responsible for their own services and advice.

Any tools, calculators, or information provided on our platform are for general guidance and preparation purposes only. They do not constitute immigration advice and should not be relied upon as such.

2. Definitions

"Client" means any individual using the Service to seek immigration assistance or information.

"Adviser" means any immigration adviser, solicitor, or firm registered on our platform to provide immigration services.

"Case Brief" means the information submitted by a Client describing their immigration needs.

"Offer" means a proposal submitted by an Adviser in response to a Case Brief.

"Engagement" means the agreement between a Client and Adviser when an Offer is accepted.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations

For Advisers: You must hold valid registration with the Office of the Immigration Services Commissioner (OISC) or be authorised by the Solicitors Regulation Authority (SRA) or Bar Standards Board (BSB) to provide immigration services.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use
  • Keeping your account information accurate and up to date

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activities.

5. Platform Services

5.1 For Clients

Our platform allows you to:

  • Create and submit Case Briefs describing your immigration needs
  • Receive and compare Offers from regulated advisers
  • Access preparation tools and resources (for guidance only)
  • Communicate with advisers through our messaging system
  • Track the progress of your immigration journey

5.2 For Advisers

Our platform allows you to:

  • Browse and respond to Case Briefs in the marketplace
  • Submit Offers with your proposed services and fees
  • Manage client engagements and communications
  • Build your profile and reputation on the platform
  • Access practice management tools

6. Marketplace Rules

6.1 Case Briefs

Clients must provide accurate information in their Case Briefs. Misleading or fraudulent information may result in account suspension.

6.2 Offers

Advisers must submit honest and accurate Offers. All fees must be clearly disclosed. Offers are binding for the validity period stated.

6.3 Engagements

When a Client accepts an Offer, a direct contractual relationship is formed between the Client and Adviser. VisaWiser is not a party to this contract.

6.4 Fees and Payments

Payment for immigration services is made directly between Clients and Advisers. VisaWiser may charge platform fees to Advisers as set out in the Adviser Agreement.

7. Adviser Obligations

Advisers using our platform must:

  • Maintain valid OISC registration or SRA/BSB authorisation at all times
  • Comply with all regulatory requirements and professional standards
  • Provide services with reasonable skill and care
  • Maintain appropriate professional indemnity insurance
  • Respond to client enquiries within reasonable timeframes
  • Not engage in any misleading or unfair practices
  • Keep client information confidential

8. Prohibited Conduct

You must not:

  • Provide false or misleading information
  • Impersonate another person or entity
  • Use the Service for any unlawful purpose
  • Attempt to circumvent platform fees or processes
  • Harass, abuse, or harm other users
  • Interfere with the operation of the Service
  • Scrape, copy, or harvest data from the platform
  • Use automated systems without our permission

9. Intellectual Property

All content, features, and functionality of the Service are owned by VisaWiser Ltd and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

You retain ownership of any content you submit to the platform, but grant us a licence to use, display, and distribute such content as necessary to provide the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy, completeness, or usefulness of any information on the platform. We are not responsible for the quality of services provided by Advisers.

Tools, calculators, and resources are for general guidance only and should not be relied upon as immigration advice. Always consult a regulated adviser for specific advice.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • We are not liable for the actions or omissions of Advisers
  • Our total liability shall not exceed the fees paid by you in the preceding 12 months
  • Nothing in these Terms excludes liability for death, personal injury, or fraud

12. Indemnification

You agree to indemnify and hold harmless VisaWiser Ltd, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will remain in effect.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any disputes.

For disputes between Clients and Advisers, we encourage parties to first attempt to resolve the matter directly. We may offer mediation services but are not obligated to do so.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email or through a notice on our platform. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
